SMS Marketing Terms & Privacy Policy — All But 6 Records

This SMS Marketing Terms & Privacy Policy ("Policy") explains how All But 6 Records ("we," "us," or "our") collects, uses, and protects your personal information when you opt in to receive text messages (SMS) from us through Shopify Messaging, and it sets out the terms you agree to by subscribing.

This Policy supplements our general [Privacy Policy] and [Terms of Service]. Where this Policy and our general Privacy Policy conflict on matters specific to SMS communications, this Policy controls.

1. Consent to Receive SMS Messages

By providing your mobile phone number and opting in through our website checkout, signup form, keyword text, or other enrollment method, you consent to receive recurring automated marketing and transactional text messages (e.g., order updates, promotions, discounts, cart reminders, and other account notifications) from All But 6 Records at the phone number provided.

Consent to receive SMS marketing messages is not a condition of any purchase. Message and data rates may apply.

By opting in, you also confirm that:

  • You are the account holder for the mobile number provided, or you have the account holder's permission to provide it.

  • You are 18 years of age or older (or the age of majority in your jurisdiction).

2. Message Frequency

Message frequency varies depending on your interactions with us (for example, abandoned cart reminders, order and shipping updates, and promotional campaigns). You may receive multiple messages per month.

3. How to Opt Out

You can opt out of receiving SMS messages from us at any time by replying STOP to any text message you receive from us. After you send STOP, we will send you a one-time confirmation message that you have been unsubscribed, and you will no longer receive SMS messages from us unless you re-subscribe.

4. Supported Carriers

Carriers are not liable for delayed or undelivered messages. We are not responsible for any delays in the receipt of any SMS messages, as message delivery is subject to effective transmission from your network operator.

5. Information We Collect

When you opt in to SMS marketing, we collect and store:

  • Your mobile phone number.

  • Your name and other contact or account information you provide (e.g., email address, shipping address, order history), where applicable.

  • Records of your consent, opt-in method, and opt-out requests.

  • Engagement data related to the messages we send you (e.g., delivery status, whether a message was read or clicked, where technically available).

6. How We Use Your Information

We use the information collected through SMS opt-in to:

  • Send you the marketing and transactional messages you've subscribed to receive.

  • Personalize the content and timing of messages based on your activity with our store (e.g., cart activity, order status, past purchases).

  • Maintain accurate records of consent and opt-out status, as required by law.

  • Improve our marketing programs and customer communications.

We do not sell your phone number or SMS opt-in data to third parties, and we do not use your consent to receive SMS messages for any purpose other than the purpose for which the consent was given.

  • Shopify Inc. and its Shopify Messaging platform, which we use to send and manage SMS communications.

  • Mobile carriers and telecommunications providers, solely to the extent necessary to deliver messages to your device.

  • Service providers who help us operate our store and marketing programs (e.g., order fulfillment, customer support), where relevant to fulfilling your order or request.

These third parties are only permitted to use your information as necessary to provide services to us and are bound by their own privacy and data protection obligations.

8. Your Rights

Depending on where you live, you may have the right to:

  • Request access to the personal information we hold about you.

  • Request correction of inaccurate personal information.

  • Request deletion of your personal information, including your SMS opt-in and message history.

9. Legal Basis and Compliance

We collect and process SMS opt-ins in accordance with applicable laws, including (as applicable to you):

  • The California Privacy Rights Act (CPRA) and other applicable U.S. state privacy laws.

  • The EU General Data Protection Regulation (GDPR) and ePrivacy Directive, for customers in the EU.

  • The UK Privacy and Electronic Communications Regulations (PECR) and UK GDPR, for customers in the UK.

10. Data Retention and Security

We retain your phone number, consent records, and related SMS data for as long as necessary to provide our SMS marketing program, comply with legal obligations (including proof of consent), resolve disputes, and enforce our agreements. We use reasonable administrative, technical, and physical safeguards to protect your information from unauthorized access, use, or disclosure.

11. Children's Privacy

Our SMS marketing program is not directed at, and we do not knowingly collect phone numbers or personal information from, individuals under 18 years of age (or the applicable age of majority).

12. Changes to This Policy

We may update this Policy from time to time to reflect changes in our practices or for legal, operational, or regulatory reasons. The "Last updated" date at the top of this page reflects the most recent revision. Continued enrollment in our SMS program after changes take effect constitutes acceptance of the updated Policy.
